Insurance Claims

Legal representatives/solicitors wishing to submit a claim on behalf of their client should submit the same via a Claims Notification Form on the Claims Portal searching for ID D00019 where the Council’s Claims Handlers, Gallagher Bassett, will take over conduct of the claim. If the claim does not qualify for the Claims Portal, then it should be submitted as for unrepresented claimants below.

Legal representatives/solicitors wishing to submit a claim on behalf of their client should submit the same via a Claims Notification Form on the Claims Portal searching for ID C00108 where the Council’s Claims Handlers will take over conduct of the claim. If the claim does not qualify for the Claims Portal, then it should be submitted via one of the options below (as for unrepresented claimants).

However, all motor related whiplash injury claims up to the value of £5,000 and occurring on or after 31 May 2021, must, under the Ministry of Justice Whiplash Reforms (Civil Liability Act 2018), be submitted electronically via https://www.officialinjuryclaim.org.uk/ where they will be directed to the Council’s Insurer. This applies to all claims whether being initiated by claimants in person, solicitors or accident management companies.

Unrepresented claimants - individuals wishing to make a claim against the Council, should submit full details including exact locus of the incident, relevant time and date, photographic evidence of both the defect and damage/injury etc via email to insurance@sefton.gov.uk

Following the introduction of the Damages Claim Portal (DCP), should court proceedings be issued, the following solicitors are nominated to accept service on behalf of the Council –

Please ensure the following:

  1. Use of dcp@weightmans.com as the defendant solicitor’s email address
  2. Quote reference “Sefton Council” as the defendant reference

Proceedings, other than those being submitted via the DCP, may be served by email via serviceofproceedings@weightmans.com

Please note – Due to large deductibles on insurance policies, Sefton Council pays the majority of any successful insurance claims from its own Insurance Fund.  Only when this deductible is breached does the Insurer contribute to the settlement.
